Back in fall of 2015 Ms Tammy Reinke , was hired as my family’s real estate agent. She was well aware that the property we were searching for was going to be used as a rental, and be homesteaded to other members of the family. In December of 2015 , my grandparents purchased a townhome showed to us by Tammy, and another sales rep. Ms Pamela Wilson, who both again reassured us that the property could be homestead/rented/sub-leased what have you.
Late December , a week after closing . Myself, and family moved into the property my grandparents had purchased. However, in January , less then 30 days after closing on the house, I the tenant of the property received a letter from the Cherry Wood Home Owners Association boards president at the time Ms Janice Emanuelson stating that myself and my family must vacate the property in 10 days due to their HOA policy stating that “owners MUST reside at the property or else the property is to remain vacant, and that we may be subject to fines and/or enforcement action such as legal, etc.” A major detail that Ms Pamela Wilson, who was the licensed subject matter expert retained for the sale transaction, should have been cognizant of. Tammy as an agent also failed her job , by showing us the property and other properties within that particular HOA in the first place. Well aware of the conditions I explained above. For a licensed agent whom specializes in the area , one would think she’d be up to date and familiar with the HOA bylaws as she is still currently selling homes in. Ms. Reinke was notified immediately about the letter received by the HOA , initially she agreed to help. But failed to communicate with us for over 6 weeks! Her absence of a response and additional help from Edina Reality showed very poor professionalism and violated several articles of the Realtors Code of Ethics . Eventually, in March of 2016 , Edina Realty Officials reached out to my grandparents and proposed we do a ‘contract to deed’ as A solution for the HOA , so my family could move back -into the home legally. They also made it seem like it was our only option at the time to avoid the legal action of the HOA. Again Assured by the agent that this was going to resolve everything . We did the contract and here we are almost 4 years later still dealing with the hoa on our own and once again facing possible eviction due to this ‘contract to deed’ Which is NOT what I wanted nor my grandparents. This undue burden of stress and unsatisfaction has affected everyone involved . Not only financially, but mentally as well. I’d like to add that i was pregnant during the whole ordeal, and gave birth only days after receiving the vacate notice by the HOA and was coursed by Tammy and my grandparents to sign a contract deed just 6 weeks after delivery! As you can imagine the stress of all this didn’t help with my postpartum depression and the anxiety of all this caused multiple other health related issues as well. So much damage and bulsh*t caused by negligence on the part of Edina Realty’s agents, I strongly advise to seek elsewhere when your looking for a home and don’t waste your time hiring one of their agents , in all fairness we got the politeness and friendliness we expected in our agent however, not the intelligence
