These are the experiences and opinions of Nick Harris regarding the Kaiser Arbitrator, Steve Schrey in a medical malpractice claim against Kaiser Permanente.14708 The connection between Kaiser counsel and Schrey offered no Matthews v Eldridge fair Trial. I am not a lawyer but have a J.D . The Bias oozed from the proceedings, in Schrey and counsel stating they had not received important documents even though proof of service were in hand. Their expert witness had settled recently in a claim for malpractice/ He is an 81 year old that his readings of the medical records should be a comedy routine, minimizing the maximum and maximizing the minimum; citing one inaccuracy after another and contradicting him self . The arbitrator Schrey, has more on his plate than he can handle of course the he works with opposing counsel to entrap the plaintiff at Summary Judgment, and by simply ignoring probative evidence and documents allegedly not received,. Kaiser had a slam dunk . The O.I.A is a joke in handling Bias claims. The take home message is the money trail, Schrey has never ruled against Kaiser and wants repeated business so his decisions will be in their favor and of course this can only be achieved with the Arbitrator and Kaiser counsel working together . There was communication between them that of course is Bias CCP170, but there is NO real neutral authority to enforce the law . Kaiser loves to be sued , that is why they have grievance handbooks at every exit of every facility , because in the end they know there going to win , If these claims went to Superior Court they would lose at least 50% of their cases and that s why every Kaiser patient agrees in advance to Arbitration.
