Okay, let me respond to this line by line. First of all, as far as the number of jail visits, I’m pretty sure I visit clients in jail more than the average criminal attorney. Also, I accept collect calls from jail, so communication, in my opinion, was not an issue. I don’t recall the specific conversation about not visiting because of the heat, but I’m pretty sure that at most I commented on that rather than saying that’s the reason I didn’t visit more often. As to saying that the client was guilty, I believe what I said was that the prosecution’s evidence was very strong, including the client admitting the crime to police, video identification, cell phone records, and the testimony of codefendant, among other things. It’s pointed out here that I was appointed by the government, meaning that I was also PAID by the government. On an hourly basis. That’s significant on this point because if I didn’t care about the client’s best interest I would have encouraged him to go to trial…in which case I would have made thousands and thousands of dollars. I know this is a crass thing to mention, but it squarely goes against the claim that I just wanted to sell the client up the river. Having said all this, naturally I regret that any client and/or his family member rate me poorly, not just because of the hit on my reputation, but because I strive for my clients to feel that they received the BEST service and the BEST lawyer in the court. There are some cases, such as this one, where the best that can be done is damage control. Note that for the client in this case, I went above the head of the main prosecutor supervisor of the courthouse, which is RARELY done, and had a meeting with a division director. The offer was lowered as a result, but as pointed out here by the mother, it was still very high. The client was facing situation if he went to trial that he would not be eligible for parole till he was very, very old, if at all.
