Several years ago I became the trustee for a trust my dad set up before his death. There are two properties in the trust and both had previously been covered by Allstate. When I explained the trust situation and even gave them all the legal trust paperwork they refused to ever change the insurance and put it in the name of the trust. Instead they continued with it under the name of my mother. I tried numerous times over the years to explain that the coverage wasn't really operating the way it was supposed to legally. I tried over and over to get them to make the changes. My mother-who is benefited by the trust and whose name the original beneficiary was when my dad was the policy holder- told them the same thing. The way that they wanted to keep it wasn't even legal, as my mom's name wasn't on the ownership of those properties at all. I'm the beginning I couldn't even get them to mail me the bills even though the payments were coming from the trust. After multiple late payments because I had never received bills as they were mailed to my mom-not the property owner-at her past address, I finally persuaded them to add my address. But it was still in my mother's name. I felt a loyalty to the company because it's what my dad had originally chosen. But eventually I had an insurance expert look at the situation. We realized that if anything happened to either property with the insurance in my mom's name, probate would have to be opened again to handle the payment! After five years post my dad's death that would be a legal mess! Thankfully I was able to change our coverage to another carrier who set up the insurance in the name of the trust. I was so glad because when Allstate mailed our small refund, sure enough it was in my mom's name, not in the name of the trust which has been making the payments for the last five years. For that small amount this wasn't a big deal. But if we had lost or had much damage to one of the properties that would have been a legal fiasco. If you have a unique situation like a trust, don't use Allstate without making sure all your bases are covered. Because they didn't treat our trust in the way it was legally laid out we would have had a real mess had we had to actually use the insurance.
