Just purchased a home from the owner dave. Seemed like a decent guy. On the morning of inspection I showed up early to find him in front of the house sweeping rain water across the street before anyone can see it (uneven road pooled rain water to the property flooding the front yard/street. While that part is a fact, it would only be purely speculative to say that one might assume it was an attempt to hide the issue.
While under contract he declined to replace the broken window sashes (fire hazard) declined to fix improper grounds in dining room (fire hazard) on top of the central ac not working we still moved foward, after all we were aware of THESE defects and could determine whether or not we were okay with them..
Prior to closing I asked numerous times if ALL of the water drain lines were updated to city water and I was finally assured they were. 2 weeks after closing and moving in, we find out that the crawlspace is flooded. The washing machine waste line pours directly into the crawlspace. Not from a leak. The washing waste line runs to the old septic tank that is out of service, gets backed up and flows directly into the crawlspace. So everytime we did laundry, we dumped gallons of water into the crawlspace. So water proofing and mold remediation are now added on top of the other costly repairs.
When I brought it to his attention that we were bamboozled by a hidden defect, he called me and put me on a conference call with his "plumber" so I can explain the issue to him. The plumber swore he tested that particular drain long enough and assured me it was hooked up. I Informed him it took just about a minute for the water to back up and run into the crawlspace and he should know that. So he changes his story to he tested it for 30 minutes. The crawlspace would've been a swimming pool if that were true. So thats a little insight as to the quality of work done by the sub contractors he uses.
As a contractor, how could you expect to sell a house like that? Well, the house was sold conveniently when the city of Hazlet wasn't doing in person CO inspections due to the pandemic. Jackpot right? Sure, someone might argue that we had our inspection done and we should've known. Well.. that was a hidden defect as we couldn't test it during the walk through. Its our problem now and thats okay. This is just to inform potential buyers about the absolutely horrible experience we've had working with him.
While I understand Dave is in no way obligated to fix any of these issues because after our above asking price offer was accepted, we had to sign a contract stating inspection is for "information purposes only" and house is "as is" I am still well within my right to leave a review regarding our experience purchasing from him.
Another fun fact, when the previous owner of a home owes utility companies a bunch of money, it becomes a headache providing extra documentation to transfer utilities into your name (to prove you bought the house and aren't essentially transferring utilities into a different name to bypass paying the debt) So thats something you don't want to experience either.
