    I just closed escrow on a transaction with Denise Gomez and Jonathan Fisher of Big Block Realty. Denise Gomez just represented me as my buyers agent in the purchase of my first home. The sellers agent (who happens to be her boss), Jonathan Fisher, was also horrible. The experience altogether was scarring to say the least. I am questioning whether Denise met her fiduciary responsibilities to me at all. The primary issue being both negligence and lack of representation. When I told her the comps didn't match where we went in on the offer she sent me a very aggressive text saying that this is what I agreed to and I promised the sellers and I'm required to deliver. She did not offer me any guidance or advise me that I could walk away from my earnest money deposit if I was unhappy. I had to request both the listing agent and selling agent disclosures of the visual condition of the property. She did not tell me that these forms were required. Denise told me that there is 1 electric bill that is through the solar company. It was not until the solar transfer agreement process took place (after my earnest money deposit was wired) that I found out from the solar company that there are actually 2 bills - one from the solar company and one from SDGE. I then asked for 2 copies of the Solar/SDGE bills for both a winter month and a summer month (so I could see tentative AC costs) and only 1 bill was provided. Denise did not offer any guidance that would protect me while the sellers remained in the home.  I later learned of the seller in possession form that would protect me while the sellers remained in the house for 2 weeks after I had closed escrow. She said I would just be protected automatically which is not true. Denise would just send DocuSigns to my email and I had no idea what they were and would constantly reach out to her for clarity to which I received no response. The Termite Inspection report was a year old. The dates lined up with the escrow the current sellers were in when buying the property a year ago when Denise told me that the termite inspectors were at the house the day prior. In escrow I asked Denise multiple times about the backyard patio permits and never received a response. In addition, Denise told me that because we put in the offer as "As Is" condition that she would not ask the listing agent if the sellers would clean up the dog poop from the yard and that they would not be having the house professionally cleaned. Per the Remain in Possession Addendum, it states that the home needs to be handed over in substantially the same condition as on the date of acceptance. At that time the house was spotless and I have photographs to substantiate it. At a personal level, the most disappointing part to me was that I asked her multiple times to ensure the sellers cars were not in the driveway so that I could take a pictures in front of my brand new home at the final walk through and this minor wish was not granted. She then refused to ask the sellers if they would be willing to let me know when the cars would not be on the driveway at any point during the upcoming week because I needed to honor the agreement in which "I'm not allowed to go to the property for the next 2 weeks." After reviewing the seller in possession addendum after closing, I discovered that Denise did not inform me of my rights as the homeowner. These are just some of the many issues that I have had with Denise and her lack of representation during this process. Today was supposed to be the best day of my life and the house was full of dog feces, pubic hair, trash and junk, bugs and spiders in the windowsill. Never work with Denise Gomez, Jonathan Fisher or any member of Big Block Realty.
