Builder Who Will Defraud Homeowners

Beware against using this builder in Rockwall, TX... Matt Everett and Everett Custom Homes The builder refuses to help us get a massive water leak corrected for the last 2 years. Here is the letter we sent with NO REPLY or RESPONSE other than a text message stating 'I will not bear an expense created by you...' Here is the letter for you to read. Trust me avoid this builder so your family will never suffer this grief. Dear Matt Everett: We have some repairs and unresolved issues at our home that you built for us. Please help resolve this situation immediately, in a most timely fashion. Since our first meeting on March 17, 2014 where we were able to voice our concerns with the home, we have had 5 different occasions that our chimney has leaked water into our home. The first time we forewarned you of an impending rain forecast that you said you would prevent another water intrusion but you never had anyone place a tarp or plastic over the chimney. As a result our home suffered a large leak which ruined the sheetrock in the living area and kitchen that you had to repair later. We were assured by you that the repairs would be done and the chimney leak eliminated. Not shortly thereafter in April we dealt with the same problem which was never repaired. The fresh repairs to the sheetrock and ceilings were once again destroyed, left with only your assurance it would be addressed and fixed. We were forced to have an independent roofer look at our concerns and tarp the chimney at our expense for fear of more damages to the home. Furthermore on August 9, 2014 the leak was revealed again to be unrepaired and we had to pay $600.00 to your roofing contractor and specialist, Gilley Gator General Contractors for an ‘Emergency Flash/Seal and Shingle Cricket on 2 Chimneys’ as per the invoice#1014 stated. We should not have been responsible for this since we did not even occupy the home until November 2015 with a closing date of the loan paperwork on the 25th of November 2015. This time you did have the sheetrock repaired again by your sheetrock contractor. No painting or corrective work to any extent was done to our knowledge. Finally, again after several dry weeks we had rain October 29-31st, 2015 to which the water leak from the chimney has become the worst it has been. You sent your roofer, Jimmy Patel, to test the roof and chimney on October 27th to once again determine the source and method of repairs. We were told that from him that it was not the roof leaking but the chimney at the same exact area as the multiple prior leaks. It was furthermore decided by you that it was due to faulty masonry work which you stated you should not be responsible for. Even though you were aware of this issue being repeated, you still made took no preventative measures knowing rain would be coming 3 days in advance to protect the home from further damage again! Over a period of more than 1 year and 7 months, we have faced the same problem that we feel you are responsible for addressing. We expect that the leak be repaired, whether chimney or roof is the problem. We also expect the damages to the home be repaired to the sheetrock. We request that an independent inspection company will assess the damages from the water leak to be repaired and that they are done in accordance with the proper building codes and directive from that company. Furthermore I have also provided an attachment of other issues with the home that have been yet to be resolved and are extremely important, yet do not carry the urgency that the roof/chimney repairs do.
