Dear Mr. Ventresca, We are sorry for your unpleasant experience. Mutual of Omaha takes our customers’ refinance process very seriously. We do our best to anticipate every possible complication. In the case of your transaction, an additional mortgage payment was made and detected the day prior to your transaction closing. The recording of this payment lowered your payoff figure which would have increased the amount of cash returned to you. While Mutual of Omaha detected this payment and subsequently updated the final figures, the title company who administered your closing was unable to change the figures before the Rescission period expired. As a result, your prior lender was overpaid. When this happens, your former lender is required to refund the difference within 21 days of receiving the payoff. Mutual of Omaha has learned that the title company has extended an apology to you, along with a token of their regret.
