        We used this lawyer for representation on the other side of a prenuptial. This lawyer felt it appropriate to advise the client on ways to challenge and nullify the prenuptial. Maybe that advice is better served when a divorce is actually initiated instead of before. Providing ammunition that creates hostility in what should and will be a wonderful time in life is not what you were hired to do. You were retained to help your client fully understand what they were agreeing to sign.

      As explained at our initial meeting, mediation is a process wherein both parties have an equal input. Unfortunately, if one participant does not allow the participation of the other party this is not the process that will meet your goals. Hopefully you both found a process that suits your needs.

      I did exactly as I was retained to do: I reviewed the document and advised my client as to all of the terms and conditions whether they were favorable to her, the other side or were neutral. The document reviewed was drafted by the other side (Joseph C in this matter) and his attorney using terms and conditions favorable to him. It is my obligation and responsibility as the attorney for the other party to explain all of these terms to them. Notably, the representation was over 16 months ago for a premarital agreement drafted less then a month prior to an already planned wedding date.
