Mr. Matamoros is correct that his check is overdue but he is incorrect with his facts and stating we have not been trying to resolve the problem. We represent Mr. Matamoros and we have spoken to him numerous times explaining how we are attempting to resolve the situation. Mr. Matamoros’ settlement was approved by the workers’ compensation court on April 20, 2021, and his check should have been sent to him from the insurance company by June 20, 2021. It has not been a year, but his check is about 3 months overdue. According to the insurance company, the checks were sent to the homes of our clients but were lost in transit. Each time the checks were lost, an investigation had to be conducted by the insurance company before they would re-issue new checks.I was advised by representatives for the insurance company on more than one occasion since then that the missing checks for our clients were going to be re-sent directly to our office to avoid additional delay so we could get the checks directly to our clients. Sadly, the insurance company has not done what they said they were going to do. I have apologized many times for this delay.Additionally, Mr. Matamoros suggests we received our legal fee and that’s why we don’t care about his delayed check. That is not true. We do not deposit our legal fee checks until we confirm that our clients have received their settlement money. We continue to pressure the insurance company to rectify their error and issue his check.
