    I found this law office for my husband when he was injured at CAT. The man basket he was in was hit from behind by a crane which caused pretty serious whiplash type injuries to his neck. When we initially sat down with Shay we were relieved because we felt like we were in good hands with this law office. Little did we know that initial sit down would be the last time we ever seen Shay. Right away we were directed to a secretary with all future communication and later assigned to a random office lawyer. Shay did nothing more than present as the face on the billboards. Once youre signed as a client youll get whoever they give you to work your case. That rubbed us the wrong way from the very start. I personally did a lot of the legwork on this case as far as collecting bills and gathering medical records. Despite it being a pretty clear case it dragged on forever because little details that had nothing to do with the actual accident or injury were allowed into the case. It ended up going to trial which was held in Peoria. That was inconvenient considering we live in Decatur. The trial could have went better. There were several medical things not brought up that should have and again little details that should have never even been allowed. After trial we waited an entire month before we heard anything about the decision and an additional month of waiting for the other side to appeal or not and another 2 weeks after that before picking up his check. We ended up with a significantly lower amount than originally anticipated especially considering my husband is still in pain to this day and will likely deal with this painful injury for the rest of his life. We hesitantly ended up accepting the judge's order without appealing simply because we didnt want to deal with this law office for another year. The entire experience left us feeling disappointed.

I am disheartened to learn of your dissatisfaction with the outcome of your husband's workers compensation case. Your husband's case was assigned to Graham Ogilvy, an experienced lawyer in Worker's Compensation litigation who has arbitrated dozens of cases to conclusion. Further, our firm has regular case meetings where all cases are individually reviewed by myself with the attorneys. Your husband's case was monitored by me with Graham to discuss strategy. I am always available for personal meetings if a client has questions regarding his or her case.Regarding other matters contained in your review we collect the client's medical records and most bills. The IWCC statute allows the admissibility of records from medical providers if we receive them in response to a subpoena. That is our practice. You are correct about the bills. There are many bills such as radiology and pathology bills that we are unable to obtain and we ask the client to provide us those bills as you receive them in the mail.You have described your husband's case as a "clear case" but in reality it was disputed by CAT that forced us to arbitrate your husband's case. Available hearing dates and locations are set by the Commission. There is no longer a Decatur hearing location. The setting of your husband's case at the Peoria location was again outside of our control. Arbitration settings have also been delayed as a residual of the pandemic. After a case is arbitrated the Arbitrator takes the case under consideration and issues a written decision 30 to 60 days later. After the decision is received each side has 30 days to consider an appeal before the Commission. Your husband elected not to appeal the decision as did the Respondent.As to your husband's disappointment with the amount awarded, all of the available medical evidence was admitted into evidence and your husband testified before the Arbitrator and described his ongoing pain. As stated previously he had the decision to accept or appeal the award. That was his right. In the end we prevailed on a fully disputed claim. I hope this response addresses your concerns.
