Mr. Kahn,You have never been a client of Barner & Barner, P.A. In fact, as a pro se party you litigated against our client, the personal representative and trustee, throughout the administration causing significant delays. The personal representative/ trustee had to go to court, and the court overruled your objections. Your review of Barner & Barner, P.A. is a misrepresentation and appears to be an attempt at retribution for the firm's successful defense of our client. Not as a client, but as a beneficiary and adverse party, you served a letter on my office at 10:40PM on March 23rd demanding to know why the final distributions had not yet been made following the judge’s decision against you on January 23rd. Even though a response was not required, we responded to you on behalf of our client only eleven (11) days later on April 4th. I explained that the personal representative needed to wait until your time to appeal the order expired (30 days). The personal representative then transferred estate assets to the trust (2 transactions), which concluded on March 28th. Since then, we filed the requisite evidence of estate distribution with the court, sent the court the order of discharge, which was entered, calculated final expenses of administration including final postage in the U.S. and to the Philippines, calculated distributions to each of the 16 beneficiaries, sent each beneficiary a distribution schedule, confirmed each of the beneficiaries’ addresses, and mailed the final distribution checks last week on April 27th. You complained that the petition for discharge reflected that you received the estate accounting when you had not. The petition for discharge was served on August 24th and the final estate and trust accountings were served by FedEx the next day on August 25th and via email on August 26th. The accountings were voluminous, and it took my staff some extra time to get the mailing/ Dropbox together. Despite receiving the estate accounting, you still objected to the petition for discharge, in part, because of this timing error. Regardless, there was no prejudice against anyone, and we re-filed and re-served an amended petition. Your related objection and other objections to the petition for discharge were overruled.My firm protected our client in this case and proceeded appropriately and professionally.
