The type of loan you acquired is an FHA loan which requires the buyer to move into the property when they purchase the property since this is to be their primary home. Not to rent the property to the seller after closing unless that is disclosed to the lender prior, and they agree. In reviewing your CD and closing documents it’s confirmed that this was not approved by your lender prior to closing or added to your Closing Disclosure at closing disclosing to the lender the (Escrow Hold) or exchange of funds from the seller to you for any rents. Our office had no acts in this transaction that were unprofessional, unethical, or unknowledgeable because we didn’t hold funds from the seller to give them to you. On the contrary had we proceeded with such request of disbursing funds to you after the fact we would be violating the approved FHA loan occupancy requirements that could qualify as fraud and lead to a civil or criminal lawsuit against us and\or the borrower (YOU) We followed the guidelines provide by the lender and based on your loan to avoid you the buyer having any legal issues.
