If you buy a builtwell home make sure you read the CC&Rs very carefully. I bought a built well tiny home in Lake Havasu City. It closed in December 2020. Sam had the HOA fees at $100 per month which did not cover our expenses. Sam collected $9,000 in prepaid HOA fees. He spent that on basic expenses from December 2020 till July 2021 when he was the declarant. Then we got the biggest surprise. In fine print Sam was going to add Esperanza 2 to Esperanza HOA. Sam never disclosed that to me or most of my neighbors. Sam threatened to sue the HOA when we had to raise the HOA fees to $225 per unit to cover the expenses. Sam also forgot to tell us he was going to add the 12 units to the south to our 18 unit HOA and let them use our pool and parking. A potential and subsequent buyer was waaaay smarter than Sam and the new development could not be added because Esperanza CCRs stated each unit shall have a garage. The 12 units he is currently building has carports. If you are buying at Encanto be careful!! Sam had dirt delivered and my neighbors on the south side got termites immediately after. Sam should also be careful what he says about not only his buyers but people in general. Making false allegations about anyone committing a criminal act is defamation. Sam did not include separate water meters which the water bill is now paid by the HOA. The CC&Rs state separate utility meters.
