The person who answered my call took down all my information and had Mr. Henry call me back. Mr. Henry was super nice and very helpful. image I was referred to Denise Kuestner by the Philadelphia Bar Association as an insurance expert regarding a breach of contract against a former employer, an insurance agency. She admitted to being busy with a trial and filed an appeal to Small Claims Court maximum award of $12,000 without ever explaining how we were going to exceed $12,000. We didn't get along at all and I fired her for before the Court of Commons Pleas case pleadings were filed. I caught an error that I requested to be corrected and she told me it couldn't be changed. I insisted and she filed a motion to withdraw stating I failed to pay, amongst other false assertions, although the invoice was delayed and post marked for the same day. Her own fee agreement required ongoing accounting and account replenishment which did not occur. The case pleadings fees alone were over $15,000 not including any discovery work. I can't imagine what the fees would have been if they were permitted to represent me with discovery and a trial. Every invoice billed was approximately a month delayed mailed to the wrong address approximately 3 blocks away. Some eventually made their way to me. I filed a fee dispute in July of 2021 with the Philadelphia Bar Association regarding a duplicate case cost charge, excessive fees and fees for discovery work never authorized or received. Two years later (July 2023) and we still haven't had an arbitration hearing. I learned she had an obligation to settle all fee disputes through the Philadelphia Bar Association Fee Dispute Program as a referral panel member. Instead, she intentionally harassed me by filing a lawsuit in the Philadelphia Court of Common Pleas in October 2022 and refused to withdraw her civil suit when instructed by the Philadelphia Bar Association numerous times. She harassed me for approximately 6 months until I informed her I was notifying the PA Disciplinary Board. The day before our arbitration hearing was scheduled, Denise Kuestner contacted the arbitrator privately to see if we were still on, which is against the rules. The arbitrator replied around 10 pm stating she didn't have authority to hold the hearing. Denise Kuestner was asked multiple times to withdraw her civil suit and provide evidence which she refused to do until 3 days after our original scheduled hearing.
The arbitrator recused herself over the incident as a potential witness to professional misconduct. The Philadelphia Bar Association Fee Dispute Program rules state without an approved request for continuance or failure to attend, the case can be dismissed with prejudice barring any cross claims. My request went ignored. I was available. This would never be tolerated in any other court . A few days prior to our rescheduled hearing, the arbitrator suggested we attempt to settle, if possible. I contacted Denise Kuestner and Henry Langsam and they removed the discovery fees. I wasn't pleased having to pay out more in fees than I eventually recovered ($1,000 to settle with agency) but I was prepared to end the fee issues. The Philadelphia Bar Association does not require closing documents. My payment would have been sufficient. Instead of accepting payment, Henry Langsam tried to force a global release of all foreseeable disputes where the Philadelphia Bar Association had no jurisdiction over, including release of their collection company, Langsam Borenstein Corp which made me suspicious. I'm looking into potential debt collection harassment under the Fair Debt Collection Practices Act, since they refused to withdraw their civil suit against me to harass me for 6 months, in violation of their Philadelphia Bar Association Lawyer Referral Information Services contract requiring any fee dispute be settled within the fee dispute program first. I reported. You decide.
