False Advertising On Ebay

I purchased a Samsung mobile phone from this vendor on eBay on Nov. 9, 2012. It was advertised as "brand new". A few months later, the phone developed technical issues and the manufacturer recommended factory repair. I expected the phone to be covered by the manufacturer's one-year warranty on new products. However, the manufacturer researched the phone's history, based on its serial number, and informed me that the product was "out of warranty." They told me that the phone was not "brand new" in 2012, but that it had been manufactured in 2009, and repaired by the manufacturer twice in 2010, so it was no longer covered by warranty. I Emailed the eBay seller, Mr. Sami Alboukai, informed him of the situation, and asked for his assistance. He replied that he only accepts returns for exchange or refund within thirty days of purchase. I wrote again, advising him that his thirty-day refund policy should not apply when a product is falsely-advertised as "brand new", when it is actually used a
